Terms and conditions of sale

This translation is provided for convenience. In case of discrepancy, the French version prevails.

These terms govern sales made on the Tamayyuz Broderie Livre (book.tamayyuz.fr) website between ELAÏD Maïlys (“the workshop”) and any individual acting as a consumer (“the customer”).

1. Purpose

The workshop makes personalised book covers, made to the size of the customer’s book, which the customer designs in the site’s configurator: size, fabric, embroidery, text and finishing touches (bookmarks, lace, closure…), depending on the options offered. Embroidery and text are stitched on an embroidery machine; cutting, assembly and finishing are done in the workshop.

Placing an order implies full acceptance of these terms, which the customer acknowledges having read before paying, by ticking the box provided. The applicable version is the one in force on the day of the order; it is recorded with the order.

2. Products

Each cover is a unique piece, made to order according to the customer’s choices. The 3D rendering and photographs are as faithful as possible but indicative: colours vary between screens, and slight differences in placement, stitch or shade are inherent to craft production, one piece at a time. They are not defects.

The workshop may refuse to embroider a text that is unlawful, offensive or infringes a third party’s rights; the order is then cancelled and fully refunded. The customer warrants that they hold the rights to the texts and names they have embroidered.

3. Prices

Prices are in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code. The price of each design is calculated in the configurator, item by item, and summarised before payment.

Delivery costs depend on the country and on the delivery method — pickup point or home delivery — and are added to the price of the designs:

  • Mainland France and Monaco: €3.90 to a pickup point, €6.90 to your door, free on orders from €90.00
  • Europe (European Union, United Kingdom, Switzerland, Norway…): €8.90 to a pickup point, €14.90 to your door, free on orders from €150.00
  • French overseas territories: €14.90 to your door, free on orders from €150.00
  • Other countries served: €24.90 to your door

The rates that apply are those shown when ordering, before payment.

Pickup point delivery is offered in the following countries: France, Belgium, Luxembourg, Netherlands, Spain, Portugal, Germany, Austria, Italy (mainland France only, not Monaco). Elsewhere, delivery is to the customer’s door.

Any customs duties and import taxes outside the European Union are payable by the customer.

4. Orders

The customer designs their piece, adds it to the cart, enters their contact details and delivery address, accepts these terms, then pays. The contract is concluded when payment is accepted; the workshop immediately sends confirmation by email, with the order summary.

An order holds at most ten different designs, each in at most nine copies.

5. Payment

Payment is made by bank card, in full when ordering, on the secure page of our provider Stripe. The workshop never sees the card details. Production only begins once payment has been received.

6. Production and delivery

Each design is made in the workshop within an indicative 7 to 15 working days after payment, then shipped to the address or pickup point chosen by the customer. Transit time depends on the carrier and the country. Delivery takes place no later than thirty days after the order, unless a different time was announced to the customer.

The customer is informed by email of each stage: confirmation, production, dispatch. They can track their order at any time using the link received.

The risk of loss or damage passes to the customer when they take physical possession of the parcel. If delivery is late beyond the announced time, the customer may, after asking the workshop to deliver within a reasonable additional period, terminate the contract under articles L216-6 et seq. of the French Consumer Code.

The customer checks the parcel on receipt and reports any damage to the carrier and to the workshop as soon as possible.

For pickup point delivery, the carrier notifies the customer when the parcel arrives; the customer has the time stated in that notice to collect it. A parcel not collected in time returns to the workshop, and sending it again is at the customer’s expense.

7. No right of withdrawal

Under article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. As the workshop’s covers are made to measure according to the customer’s choices, the customer has no right of withdrawal.

Consequently, once paid, the order is final: it cannot be cancelled, exchanged or returned, and gives rise to no refund for convenience or change of mind. The customer is informed of this before paying, and expressly accepts it by ticking the box provided.

This absence of a right of withdrawal does not deprive the customer of the legal guarantees described below.

8. Legal guarantees

The customer benefits from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

  • The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, they only need to establish the existence of the lack of conformity, not when it appeared.
  • The legal guarantee of conformity entails an obligation to repair or replace the goods or, failing that, to reduce the price or terminate the contract with a refund.
  • In the event of a hidden defect making the goods unfit for their intended use, the customer may request termination of the sale or a price reduction within two years of discovering the defect.

To invoke a guarantee, the customer writes to the workshop describing the defect, with photographs. The cost of returning goods recognised as defective is borne by the workshop.

9. Customer service and complaints

10. Personal data

The data needed for the order are processed in accordance with our privacy policy.

11. Mediation and governing law

In the event of a dispute, the customer first sends a written complaint to the workshop. If no solution is found, they may refer the matter free of charge to the consumer mediator: [Nom du médiateur] — [https://site-du-mediateur.fr].

These terms are governed by French law. Failing an amicable agreement, the competent courts are those designated by ordinary rules.
